Sex offender with duct tape is caught in a child’s room
A Grayson father and mother captured a convicted sex offender in his young daughter’s bedroom early Tuesday morning and held him with duct tape until law enforcement arrived.
The suspect has been identified as Daniel Diaz, 39, of Turlock.
Diaz was reportedly found in the bedroom of a 5-year-old girl.
The incident began early Tuesday morning when the girl’s mother came out of her bedroom and spotted Diaz through the living room window. Diaz would have stood in front of the window touching himself and saying “I love you”.
The father came out and yelled for Diaz to leave. The father then went to the kitchen window to see if Diaz was leaving. Looking out the window, he heard the rustling of the blinds in his daughter’s room.
The father went to his daughter’s bedroom and found Diaz in the bedroom with his sleeping daughter.
Diaz was dragged out of the house by his father and twice tried to get into the house. Eventually, the parents used duct tape to hold it down and held it on until deputies from the Stanislaus County Sheriff’s Department arrived.
No injuries were reported as a result of this incident.
Diaz was wearing an ankle monitor at the time of his arrest. In 2020, he was convicted of assault and battery on a guard officer. According to court records, he was sentenced to two years in prison, but was subsequently granted parole. He violated that parole in January this year and served 20 days of a 180-day sentence, then raped her again in May. This time, he served 69 days out of a 140-day sentence.
Diaz is a sex offender convicted of a 2009 conviction for assault with intent to rape. In this case, Diaz walked into the victim’s house in Newman, slipped into bed with her, rubbed her thigh, and whispered, “I’m Daniel.” The developmentally delayed victim jumped up and ran towards the kitchen. Diaz pushed the victim into the bedroom and onto the bed. The victim bit Diaz and fled, according to the Stanislaus County District Attorney’s Office.
For his latest incident, Diaz was arrested and jailed in Stanislaus County Jail for burglary, endangering children, clairvoyance and parole violation. He remains in detention.
